Dogtown, Inc. and Dogtown Brickell, Inc. Open Environment Incident Coverage Contract
1. Introduction:
This contract (“Contract”) is entered into on this date [Date], by and between Dogtown, Inc. and Dogtown Brickell, Inc., collectively referred to as “Dogtown,” and the client (“Client”) who wishes to purchase the Open Environment Incident Coverage (“OEIC”) service offered by Dogtown. This Contract outlines the terms and conditions of the OEIC service, which is designed to provide coverage for medical care expenses arising from dog-to-dog altercations during the Client’s dog(s) stay with Dogtown.
2. Description of OEIC:
OEIC is a per day, per dog fee offered by Dogtown for the duration of the Client’s dog(s) boarding stay with us. The fee covers up to $500 in medical care expenses incurred due to injuries resulting from altercations with other dogs while the dog(s) are under our care.
3. Coverage Terms:
3.1 Eligibility: OEIC coverage is optional and can be purchased by the Client for their dog(s) during the boarding stay at Dogtown. The coverage is only active during the current stay for which the Client has purchased the coverage.
3.2 Incident Coverage: The OEIC specifically covers medical care expenses up to $500 that arise solely from altercations with other dogs while the Client’s dog(s) are in the care of Dogtown during the boarding stay.
3.3 Exclusions: OEIC does not cover any pre-existing illnesses or injuries present in the Client’s dog(s) before drop-off for boarding. It also does not cover injuries caused by the Client’s dog(s) on other dogs.
3.4 Payment and Reimbursement: In the event of an eligible incident, Dogtown will cover up to $500 of the medical care expenses. These expenses may either be paid directly to the vet by Dogtown, in the case of Dogtown providing the medical care, or reimbursed to the Client after an invoice is submitted and approved by Dogtown. Reimbursement requests must be made within 48 hours after the Client picks up their dog(s) from our facility. Requests must be accompanied by photos and a copy of the vet bill related to the incident.
4. Non-Insurance Program:
4.1 Understanding: The Client acknowledges that OEIC is not insurance coverage but a program offered by Dogtown to assist in payment for injuries resulting from open environment interactions with other dogs during the Client’s dog(s) stay.
4.2 Discretionary Approval: The Client understands that the request for payment or reimbursement of medical care expenses can be denied by Dogtown at its sole discretion for any reason whatsoever.
4.3 Non-Refundable Fees: The Client acknowledges that any fees associated with the OEIC service are non-refundable for any reason whatsoever, including, but not limited to, early check-out or cancellation.
5. Assumption of Risks:
The Client acknowledges that there are inherent risks associated with an open environment where dogs are allowed to interact freely. However, the Client understands that the benefits of such an environment outweigh the risks, and they willingly assume these risks by choosing to utilize the OEIC service.
6. Governing Law:
This Contract shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of laws principles.
7. Entire Agreement:
This Contract constitutes the entire agreement between Dogtown, Inc., Dogtown Brickell, Inc., and the Client regarding the OEIC service and supersedes all prior negotiations, agreements, and understandings, whether written or oral.
